Welcome to www.waterlilycounseling.com (the "Site"), operated by Water Lily Counseling, PC ("we," "us," "our," or the "Practice"). These Terms and Conditions ("Terms") govern your use of this Site and, where noted, your engagement with our clinical services. By accessing or using this Site, you agree to these Terms. If you do not agree, please do not use the Site.

This Site is for informational purposes and to facilitate scheduling and communication with our practice. It is not intended for emergency use. If you are experiencing a mental health emergency, are in crisis, or are at risk of harming yourself or others, do not use this Site or email/contact forms to reach us. Instead:

• Call 911 or go to your nearest emergency room, or
• Call or text the 988 Suicide & Crisis Lifeline (available 24/7 in the U.S.)

We do not monitor this Site or our contact forms/email continuously and cannot guarantee an immediate response.

Water Lily Counseling, PC provides mental health counseling services delivered by Sabiha Zaman, LICSW, LCSW licensed in MA and VA. Services may be provided via telehealth, subject to applicable licensing laws, which generally require the client to be physically located in a state where the clinician is licensed at the time of each session.

Information on this Site (including blog posts, resources, or general content) is provided for educational and informational purposes only and is not a substitute for personalized clinical advice, diagnosis, or treatment. We make no representation or warranty that information on the Site is accurate, complete, current, or error-free, and we disclaim liability for any inaccuracy or omission. No therapist-client relationship is created simply by browsing this Site, submitting a contact form, or requesting information. You accept that any information on this Site may be incomplete or outdated and agree to conduct your own due diligence before relying on it.

We offer telehealth (video or phone) sessions:

• Telehealth involves the use of electronic communications to enable clinicians and clients to communicate remotely, and carries inherent risks including technology failure, interruptions, and potential limits on privacy.
• Telehealth is not appropriate for all clinical situations (e.g., certain crises, some diagnoses); your clinician will discuss this with you directly.
• You are responsible for ensuring you are physically located in a state where your clinician is licensed at the time of your session, and for using a private, secure location and connection.

Appointment scheduling, cancellation, and late-cancellation/no-show policies (including any fees) are governed by the individual client agreement you sign at intake, not solely by this Site. Generally:

• Cancellations and reschedules require at least 36 hours notice.
• Late cancellations or no-shows may be subject to a fee of $100, which is not billable to insurance.

Session fees, accepted payment methods, and insurance participation (if any) are outlined in your client intake paperwork and/or a Good Faith Estimate provided in accordance with the No Surprises Act. Fee information published on this Site is for general reference and may not reflect your specific rate, insurance benefits, or any applicable sliding-scale arrangement.

Protected health information shared during treatment is handled in accordance with the Health Insurance Portability and Accountability Act (HIPAA) and applicable state law, as described in our Notice of Privacy Practices, provided separately at intake. Confidentiality has legal exceptions (e.g., risk of harm to self or others, suspected abuse of a child, elder, or dependent adult, and certain court orders), which your clinician will review with you.

Use of this website itself (browsing, contact forms) may involve standard web technologies (such as cookies or analytics) as described in our Privacy Policy. This Site should not be used to transmit sensitive clinical information; please use secure, agreed-upon channels (such as a HIPAA-compliant client portal) for anything containing protected health information.

To access or use this Site, you must be 18 years of age or older, or the parent/legal guardian of a prospective client, and have the authority to enter into these Terms. You agree to use this Site only for lawful purposes. You will not post or transmit through the Site (including via any contact form) any material that is threatening, abusive, defamatory, obscene, or that otherwise violates the rights of others or applicable law.

All text, graphics, logos, and other content on this Site are the property of Water Lily Counseling, PC or its licensors and are protected by copyright and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and view this content for your own personal use. You may not modify, publish, transmit, distribute, create derivative works from, or otherwise exploit any of this content without our prior written consent. This content is not for resale, and use of the Site does not grant you any ownership rights in it.

This Site may link to third-party websites or resources (e.g., insurance portals, crisis resources, professional directories) for your convenience. We do not control and are not responsible for the availability, accuracy, or privacy practices of any third-party site, and a link does not imply our endorsement of it. You assume all risk arising from your use of any linked third-party site or resource.

We do not warrant that this Site will be uninterrupted, error-free, or free of viruses or other harmful components, and we will not be liable if the Site or any part of it is unavailable at any time or for any period. All information you transmit to or from this Site is transmitted at your own risk. You agree to hold Water Lily Counseling harmless from any losses, damages, or claims — including reasonable attorney's fees — arising out of your breach of these Terms or your misuse of this Site.

This Site is intended for use by adults. Services for minors require consent from a parent or legal guardian in accordance with [state] law, and are governed by a separate intake and consent process.

These Terms are governed by the laws of the State of Virginia, without regard to conflict-of-law principles, and any dispute relating to these Terms will be brought exclusively in the courts located in Virginia.

Section headings are for convenience only and do not affect interpretation of these Terms. If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Water Lily Counseling regarding use of this Site and supersede any prior understandings on the subject.

We may update these Terms from time to time. The "Last Updated" date reflects the most recent revision. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
